Welcome to the Kitty’s Confections website (www.kittysconfections.com)! These Terms & Conditions ("Terms") govern your use of our website and your purchase of products from our home bakery. By accessing our site or placing an order, you agree to these Terms.
1. Texas Cottage Food Law Disclosure
Kitty’s Confections operates under the Texas Cottage Food Law.
Home Kitchen: Our food is prepared in a home kitchen that is not inspected by the Department of State Health Services or a local health department.
Local Only: By law, we cannot ship products through the mail. All orders must be picked up locally in Decatur, Texas, or delivered personally within our designated service area.
Labeling: All products will be labeled with our contact information and a list of ingredients, including major allergens.
2. Ordering & Payment
Full Payment Required: To secure your order and pickup date on our calendar, payment in full is required at the time of checkout. We do not "hold" dates without payment.
Order Confirmation: Your order is not confirmed until you receive a confirmation email from us. Please review this email immediately to ensure all details (flavor, pickup date, spelling of names) are correct.
Right to Refuse: We reserve the right to decline any order if our calendar is full or if the request is outside our scope of expertise.
3. Refund & Cancellation Policy
We understand that plans can change. Our refund policy is as follows:
7+ Days Notice: Cancellations made at least 7 days prior to the scheduled pickup date will receive a 100% refund.
Less than 7 Days Notice: Cancellations made between 3 and 6 days prior to pickup will receive a 50% refund. This covers the cost of ingredients and the loss of business from holding the date.
Less than 48 Hours: Cancellations made within 48 hours of the scheduled pickup time are non-refundable.
Quality Refunds: Refunds based on quality (taste, texture, appearance) are subject to our discretion. To be eligible for a refund, the product must be returned to us within 24 hours of pickup with at least 75% of the product remaining. We do not offer refunds for products that have been consumed.
4. Pickup & Release of Liability
Timeliness: You are responsible for picking up your order during the designated pickup window selected at checkout.
Late Pickups/No-Shows: If you fail to pick up your order within 24 hours of the scheduled time without contacting us, the item is considered abandoned. No refunds will be given for abandoned orders, and we reserve the right to donate or dispose of the item to ensure freshness.
Transport Liability: Once the product is handed to you (or your designated pickup person), Kitty’s Confections is no longer responsible for its condition.
Cakes and decorated cookies are fragile. They should be transported on a flat surface (like the floorboard of your car), not on a slanted car seat.
Heat Warning: Buttercream and icing melt in the Texas heat. We are not responsible for damage caused by heat, humidity, or improper handling (e.g., leaving the cake in a car) after pickup.
5. Design & Artistic License
Inspiration: We love inspiration photos! However, please understand that baking is an art form. We will do our best to match your requested design, but we cannot guarantee an exact replica of a photo found online.
Color Matching: We make every effort to match your color palette, but due to the nature of food coloring, slight variations may occur. Dark colors (like black, navy, or red) may temporarily stain teeth or have a slightly bitter taste.
6. Allergy Warning
Shared Equipment: While we take strict precautions to sanitize our equipment, our kitchen processes wheat, dairy, eggs, soy, peanuts, tree nuts, fish, crustacean shellfish and sesame. We cannot guarantee that any item is 100% allergen-free.
Customer Responsibility: It is your responsibility to inform your guests of this allergy risk. Kitty’s Confections is not liable for allergic reactions.
7. Website Use & Intellectual Property
Our Content: All content on this website—including the Kitty’s Confections logo, text, graphics, and photos of our baked goods—is the property of Kitty’s Confections and is protected by copyright laws.
Limited License: You may view our site for your personal shopping and enjoyment. However, you may not copy, reproduce, or use our photos for your own commercial purposes without our written permission.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from these Terms or your purchase shall be resolved in the courts of Wise County, Texas.
